Terms of Service

1. Who we are

Klamdo is an AI content-generation platform operated by Klamdo (“Klamdo,” “we,” “our,” or “us”). By creating an account or using the service at klamdo.app, you (“you” or “user”) agree to these Terms of Service (the “Terms”).

2. Eligibility

You must be at least 18 years old to create an account. By registering, you represent that you are a legal adult in your jurisdiction, that all identifying information you provide is accurate, and that your use of Klamdo will not violate any law or third-party right.

3. Your account

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that appear compromised, share credentials, or show signs of automated abuse.

4. Subscriptions, credits, and billing

Klamdo is sold as a monthly or annual subscription with a credit allowance. Subscription fees and credit costs are shown at checkout and in your account settings. All fees are billed through Stripe and renew automatically until canceled. Canceling stops future renewals but does not refund the current period. Unused credits expire according to the schedule shown on the pricing page.

Refunds are considered case-by-case for failed generations, duplicate charges, or confirmed platform defects. We do not refund credits spent on outputs the user simply dislikes or on prompts that trigger provider safety filters.

5. License to your input

You retain ownership of every image, video, text prompt, and reference file you upload (“User Input”). By using Klamdo you grant Klamdo a worldwide, non-exclusive, royalty-free license to host, process, transmit, and transform User Input solely to operate the service, deliver generated outputs to you, and improve platform reliability. We do not sell User Input and we do not use User Input to train public foundation models.

6. License to generated output

Subject to your compliance with these Terms and payment of all applicable fees, Klamdo grants you a worldwide, royalty-free license to use, reproduce, adapt, distribute, and commercialize the generated outputs (images, video, audio, text) produced for your account. Because outputs are generated by machine-learning models, copyright ownership of AI-generated content varies by jurisdiction and Klamdo does not represent that any output is independently copyrightable.

7. Acceptable use

You may not use Klamdo to create, upload, store, or distribute content that:

• depicts minors in any sexual or suggestive context;
• depicts identifiable real people in sexual, nude, violent, or defamatory contexts without their verifiable consent;
• impersonates a real person for fraud, harassment, or deception, including political deepfakes designed to mislead voters;
• violates intellectual-property rights, including training on or replicating copyrighted characters, logos, or artwork without authorization;
• promotes terrorism, self-harm, illegal weapons manufacture, CSAM, human trafficking, or any other activity illegal under United States federal law;
• attempts to jailbreak, abuse, or overwhelm the platform, including prompt injection against our moderation layer, credential stuffing, and automated scraping.

8. Content moderation

We apply automated and human moderation to detect policy violations. We may refuse, block, delete, or unshare any content we reasonably believe violates these Terms, applicable law, or the policies of our upstream model providers. Repeated or severe violations result in permanent account termination without refund.

9. DMCA & copyright

Klamdo complies with the U.S. Digital Millennium Copyright Act. Rights holders who believe their copyrighted work has been used on Klamdo without authorization may submit a takedown notice per our DMCA Policy. Repeat infringers will have their accounts terminated.

10. Third-party services

Klamdo routes generation requests to third-party AI providers (including but not limited to fal.ai, OpenAI, and ElevenLabs) and uses Stripe for payments, Cloudflare for hosting and asset delivery, and Resend for transactional email. Your use of the service is also subject to those providers’ terms and privacy policies.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. KLAMDO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED OUTPUTS WILL BE ACCURATE, RELIABLE, OR FIT FOR ANY PARTICULAR PURPOSE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLAMDO’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS OR (B) THE TOTAL FEES YOU PAID TO KLAMDO IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. KLAMDO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

13. Indemnification

You will defend, indemnify, and hold harmless Klamdo and its officers, employees, and contractors against any third-party claim arising from (a) content you upload or generate, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

14. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate your account for violation of these Terms, suspected fraud, chargeback abuse, non-payment, or on reasonable notice for any other legitimate reason. Sections 5, 6, 9, 11, 12, 13, and 15 survive termination.

15. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. You waive any right to a jury trial or to participate in a class action.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by in-app notice or email. Continued use of Klamdo after changes take effect constitutes acceptance.
